Transfer to the N.D. of California Granted on Writ of Mandamus

Genentech, Inc. ("Genentech") and Biogen Idec Inc. ("Biogen") petition for a writ of mandamus to direct the United States District Court for the Eastern District of Texas to vacate its March 19, 2009 order denying the petitioners' motion to transfer venue, and to direct thta court to transfer the case to the United States District Court fo the Norther District of California.

Because the peitioners have met their burden of establishing that the district court clearly abused its discretion in denying transfer of venue to the Northern District of California and because we determine that mandamus relief is appropriate in this case, we grant the petion for a writ of mandamus.
