The 20-year-old driver of a Toyota 4-Runner died Wednesday when his vehicle was forced over a freeway guard rail and dropped to the roadway below. The Toyota was on the transition from southbound I-5 to east bound Highway 50 at around 5:45 a.m. Wednesday morning when the driver of a Mitsubishi failed to notice slowing traffic and veered right in an attempt to avoid hitting the cars ahead. However, the Mitsubishi swerved into the Toyota, which lost control, struck a guardrail, rolled over the railing and fell into the southbound lanes of I-5. The Toyota burst into flames immediately and the driver was pronounced dead at the scene. The driver of the Mitsubishi and her passenger, a 6-month-old boy, were taken to U.C. Davis Medical Center with minor injuries. This fatal Sacramento accident remains under investigation.
Based on the available information, the driver of the Mitsubishi is more than likely responsible from a legal standpoint to compensate the victims of this Sacramento auto accident. In most cases, the driver’s insurance would pay for these losses even. If she had no insurance, the victims may be able to recover under the uninsured motorist provision of an auto insurance policy covering their vehicle.
