This Appeal arose from a challenge to a Final Rule allowing the importation from Taiwan of potted moth orchids. Hawai`i Orchid Growers Association sought revision of the Final Rule claiming that required inter-agency Endangered Species Act consultations failed to eliminate grave risks to Endangered and Threatened Species in Hawai`i because Department of Agriculture's Animal and Plant Health Inspection Service had made only misleading or selective disclosures to Department of Interior's Fish and Wildlife Service of adverse and available scientific and commercial data.
