El derecho a la educación no obligatoria de los extranjeros: por fin una interpretación constitucional


Thanks to the sentence of the Spanish Constitutional Court 236/2007, of 7 November, we have known, after long years, an interpretation in constitutional key of the scope of the right to the non obligatory education of the foreigners in Spain. This right remained regulated in the reform of the Organic Law of Foreigners, specifically in the point 7 of his first article, that gave new redaction to the section 3 of the article 9 of the Organic Law 4/2000.

The Constitutional Court offers his own interpretation in constitutional key, so that it sentences in the sense to cancel the expression “resident”, pure and simply, without treating of save the precept whenever it apply in

an interpretation chord to the Spanish Constitution.
