The Main Difference Between Legal Separation & Divorce

In Arizona, a legal separation and a divorce both involve similar issues, such as child custody, visitation, child support, spousal maintenance and division of property/debts. However, the difference between the two lies in the end result. After a divorce, the spouses are no longer married and are considered to be two separate parties. On the other hand, after a legal separation is completed the two parties remain married. This means that in a legal separation, the legal rights and relationships stemming from the marriage do not cease to exist.
