SUMMARY: Petition filed in Jefferson Parish state court to remove a construction lien improperly filed on our client's property by the general contractor.
Petitions to remove improperly filed construction liens are filed in accordance with La. R.S. 9:4833 and La. R.S. 44:114.
In this case, Plaintiff argued that the lien was improper because the general contractor failed to: (a) properly identify the property; (b) get licensed to perform the work; (c) file a notice of contract; and (d) failed to identify the work giving rise to the claim.
