Plaintiff A v. Defendant B, et. al.

Memorandum of Law in Support of Motion for Judgment as a Matter of Law or, in the Alternative, a New Trial

State Trooper is entitled to judgment as a matter of law on plaintiff's claim of false arrest, or entitled to a new trial of the false arrest claim based on the the overwhelming evidence of the reasonableness of his actions. In the alternative, because the evidence does not support a claim for punitive damages, the award for punitive damages must be vacated as a matter of law.
