Robert Matthews, Jr.

Practice/Organization Description

An experienced patent litigator and author of the multi-volume patent law treatise "Annotated Patent Digest," Robert A. Matthews, Jr., provides legal consulting services to corporations and law firms on all aspects of U.S. patent law and patent litigation. Working with trial and/or in-house counsel, Matthews helps clients efficiently analyze patent issues in a cost effective manner.

Matthews has assisted clients with patent matters before the Supreme Court of the United States {primary author of the Brief of Amicus Curiae Pharmaceutical Research and Manufacturers of America in Support of Respondents before the Supreme Court of the United States in KSR Int’l Co. v. Teleflex Inc., No. 04-1350, 2006 WL 2967758 (Oct. 16, 2006)}, the United States Court of Appeals for the Federal Circuit, the International Trade Commission, the Board of Patent Appeals and Interferences in the United States Patent and Trademark Office, and federal district courts throughout the United States, including the current “hot-beds” of patent litigation like the Eastern District of Texas, the Northern District of California, the District of Delaware, the Northern District of Illinois, the District of Minnesota, the District of New Jersey, and the Southern District of New York.

Before co-founding Latimer, Mayberry & Matthews Intellectual Property Law, LLP in 2007, Mr. Matthews was a partner with the intellectual property law firm of Finnegan Henderson Farabow Garrett and Dunner, LLP. There he concentrated his practice on patent litigation in the federal district courts, patent-related appeals in the Federal Circuit and Supreme Court, preparing opinions of counsel, and providing patent-law consulting services to the lawyers in the firm and corporate in-house counsel.

Mr. Matthews extensively follows, analyzes, and writes on developments in U.S. patent law. He is the sole author of the Annotated Patent Digest, a seven-volume, 14,000 page, work published by Thomson-West and available on Westlaw. The Annotated Patent Digest covers the full spectrum of substantive and procedural issues typically encountered in litigating patent disputes. His digest also includes a wealth of legal subject matter relevant to prosecuting patent applications before the U.S. Patent and Trademark Office. In rendering rulings on patent matters, district court judges have quoted from and relied on the Annotated Patent Digest and other written works of Mr. Matthews. E.g., Renhcol Inc. v. Don Best Sports, 2008 WL 1885522, *6-*8 (E.D. Tex. April 28, 2008); Encyclopaedia Britannica, Inc. v. Magellan Navigation, Inc., 512 F. Supp. 2d 1169, 1176 (W.D. Wis. Aug. 31, 2007); Amgen v. F. Hoffman-LaRoche, Ltd., 456 F. Supp. 2d 267, 283 (D. Mass. Oct. 20, 2006); Monsanto Co. v. Bayer Bioscience N.V., 2005 WL 5989796, *16 (E.D. Mo. Oct. 28, 2005); Schreiber Foods, Inc. v. Beatrice Cheese, Inc., 305 F. Supp. 2d 939 (E.D. Wis. 2004). International commentators have also relied on the Annotated Patent Digest when discussing aspects of U.S. patent law.

Before pursuing his legal career, Mr. Matthews spent five years working as an engineer in the aerospace and nuclear industries. His engineering work focused on thermal and structural analysis, including structural analyses of the solid rocket boosters used with the NASA space shuttle, structural and thermal analyses of nuclear steam generators and automotive engine components, and thermal analyses of military aircraft components and avionics.
