David C. Brezina is counsel in the Chicago office of Ladas & Parry LLP. He is also an Adjunct Professor at The John Marshall Law School, where he has taught “Antitrust and Misuse Aspects of Intellectual Property Law.” A third generation patent lawyer, and second generation John Marshall Intellectual Property Law LLM Alumnus, Mr. Brezina has written, given interviews and lectured on IP topics frequently. He handles patent, trademark, and copyright applications, litigation, and licensing.
Problem solving for clients in the intellectual property field can take advantage of overlap between traditional intellectual property "sub-fields." A basic example is that familiarity between the respective nuances of patent prosecution and patent litigation complementing handling the other effectively. Other examples of crossovers include the impact of publication of a patent on maintenance of trade secrets, the overlap between patent, trade secret, license and copyright in computer technology, and the implications of evidence of consumer perception affecting advertising, trademark and trade dress claims. In licensing, an understanding of the underlying legal protections as well as the impact of antitrust, contract and enforcement principles can yield a synergistic solution.
