My law practice entails all aspects of business litigation, primarily in the areas of creditors' rights and civil litigation defense. I am often hired by businesses when they need a lawyer to help them collect accounts receivables, loan defaults, and open account balances for non-payment of bills. My clients run a wide range of businesses, but most typically are banks, financing companies, suppliers, and service providers. I use a variety of methods to obtain recovery for my clients, including filing lawsuits when necessary to help my clients collect what they are owed from individuals or other businesses. I am also hired local law firms to help them collect judgments, and by out-of-state law firms to domesticate and enforce judgments entered in other states when the debtor resides or owns property in Arizona.
Our firm generally handles a variety of Civil and Commercial Litigation, Business Disputes, and Creditor's Rights. We handle breach of contract, replevin, lien foreclosure, and deficiency litigation. In Bankruptcy cases, we represent creditors and trustees in deficiency litigation, discharge litigation, stay relief, preference litigation, and filing proofs of claim. Our judgment enforcement and collection practice involves asset discovery, execution of post-judgment remedies, and domestication of foreign judgments. We regularly conduct debtor examinations, garnish wages and accounts (earnings garnishment and non-earnings garnishment), and utilize writs of execution and charging orders to recover assets. We also act as trustee for non-judicial foreclosures of real property (Trustee’s sales).
