Practice/Organization Description

Attorney Marie Cheung-Truslow, Chair of the firm’s Property Insurance and Subrogation Practice Group has over 20 years experience litigating complex insurance coverage, arson and fraud defense, class action defense involving bad faith claims, and large loss subrogation.

She regularly advises insurance companies on suspicious claims involving arson and fraud, and complex insurance coverage issues. Attorney Cheung-Truslow has hands-on experience coordinating the investigation of suspicious losses and subrogation recoveries through assembling teams of forensic experts, origin and cause investigators, engineers, forensic accountants, computer experts, metallurgists, combustion scientists, and fire protection specialists to analyze and determine the root cause of the losses. She also has extensive experience conducting examinations under oath of policyholders.

Attorney Cheung-Truslow has secured numerous defense verdicts in jury trials and arbitrations. She has secured summary judgment and defeated motions to dismiss for insurance companies in various cases on fraud-related and failure to cooperate grounds, including John Aubuchon vs. National Grange Mutual Insurance Company, 70 Mass. App. Ct. 1102 (2007)(failure to cooperate); Great Northern Storehouse, Inc. v. Peerless Ins. Co., 2000 U.S. Dist. LEXIS 22905 (D. Maine 2000)(arson); The Northern Assurance Company of America v. Payzant, Massachusetts Appeals Court, 2010-P-1469 (failure to cooperate); Roche v. Provident Life & Accident Insurance Company, 40 Mass. App. Ct. 1103 (1996)(fraud claim); Allstate Insurance Company v. Keith Michael Stone, D.C.; Clinica Real, LLC et. al., United States District Court for the District Of Arizona, 2008 U.S. Dist. Lexis 27332 (2008)(Federal RICO claim).

Attorney Cheung-Truslow is a regular trainer for insurance companies on “Massachusetts First Party Property Losses.” She has also spoken on “Representing Insureds and Insurers in Subrogation Cases Where There are Coverage Issues,” NASP New England Chapter, March 2010; “Electronic Discovery and Implication on Civil Litigation,” IASIU Annual Seminar on Insurance Fraud, September 11, 2006; “Boston’s Big Dig,” The Honorable Order of the Blue Goose International, Bay State Pond Conference, 2004.
