I have successfully represented clients of every size in state and federal courts, arbitrations and mediations throughout the country in a wide variety of commercial litigation and other matters, including contract disputes, distributorship litigation, trademark and unfair competition, trademark counterfeiting, business tort claims, toxic tort and insurance coverage litigation, discrimination and wrongful discharge cases, copyright infringement claims, trade secret, restrictive covenant and real estate litigation. My law firm, Goetz Fitzpatrick LLP, is also one of the leading construction law firms in the New York area.
My litigation experience runs the gamut from pretrial investigation and early dispute resolution through every aspect of bench and jury trials as well as appeals. My team is trained to deliver the quality, sophistication and depth of big-firm litigation groups in a client-friendly, economically rational package.
I am also the general counsel of the Media Bloggers Association and have developed a reputation for my representation of clients in connection with online business and specifically the use of intellectual property on the Internet. My blog about copyright, trademark and related issues, Likelihood of Confusion, was recognized by the ABA Journal as one of the top 100 law-related blogs in the country in its first-ever listing in 2007. I wrote the first article on Internet law in that magazine (1995) as well as the various scholarly articles and book contributions on law and litigation shown in my listing here.
