I would ask a prospective client these questions:
If you are involved in eminent domain: has CEQA been complied with? Has an appropriate resolution of necessity been prepared that meets the constitutional requirements to substantiate the taking? Has the valuation process been properly complied with?
If the matter involves property development: has CEQA/NEPA, the endangered species act been complied with? Have you secured a water source? Do you have a secure "wet" water supply? Do you know the environmental condition of your property, and, if not, what to do to reduce your exposure to soil and groundwater administrative or civil action from either the: EPA; DTSC; Regional Water Quality Control Board; citizen plaintiff?
If your property has or is suspected of having a contaminant: do you know how to deal with a cleanup order and action? Do you have land and grid access to develop renewable energy sources-solar, wind farm.
I am an editor of the Environmental Liabilities, Enforcement and Penalties Reporter, a national publication to which I produced three articles monthly. I am also a member of the International Right-of-Way Association, the Environmental Section of the Orange County Bar, and am an Assistant Scoutmaster with the Boy Scouts of America.
