The U.S. Equal Employment Opportunity Commission (“EEOC”) recently announced that its 2017 EEO-1 Survey portal is now open and accepting submissions.

All private employers with 100 or more employees, as well as federal government contractors and subcontractors with 50 or more employees and a government contract or subcontract of $50,000 or more, are required to electronically file the 2017 Equal Employer Information Report EEO-1 (“EEO-1 Report”), providing workforce employment data by gender, race/ethnicity, and job category. The deadline to file the EEO-1 Report is March 31, 2018.

As in previous years, employers are to report on the number of employees within each EEO-1 job category by gender and race/ethnicity. However, employers do not need to include hours worked or compensation data. Although the Obama administration expanded the reporting requirements on September 29, 2016, to include this data, the Trump administration eliminated the expanded requirements on August 29, 2017.

Notification letters containing new passwords were sent electronically by the EEOC to employers on or before January 24, 2018; prior passwords will not work.

What Employers Should Do Now

  • File your EEO-1 Report in a timely and complete manner.
  • If you have not previously filed the EEO-1 Report and meet the employer criteria—or if you filed the EEO-1 Report in 2016 and did not receive the notification letter before January 30, 2018—contact the EEO-1 Joint Reporting Committee by telephone (1-877-392-4647) or email (e1.techassistance@eeoc.gov).
