Air Enforcement: Arkansas Department of Environmental Quality and Saline County, Arkansas Alumina Refining Facility Enter into Consent Administrative Order

The Arkansas Department of Environmental Quality (“ADEQ”) and Almatis, Inc. (“AI”) entered into an October 9th Consent Administrative Order (“CAO”) addressing alleged air violations. See LIS No. 17-081.

The CAO provides that AI owns and operates an alumina refining facility (“Facility”) in Saline County, Arkansas.

The Facility operates pursuant to Air Operation Permit 1527-AOP-R16 (“Permit”).

An ADEQ compliance inspection is stated to have been undertaken at the Facility on June 14, 2017. It is stated to have indicated that AI failed to provide records to demonstrate that it had conducted weekly observations of the opacity from sources 405BH0605 and 410BH02 from June 20, 2016 through June 9, 2017. This alleged failure is stated to constitute a violation of Specific Condition 4 of the Permit.

ADEQ is stated to have informed AI of the compliance issues identified during the inspection.

AI responded that the referenced sources had been added to the Permit. The company further responded it had inadvertently omitted those sources from the Weekly Opacity Survey that it utilizes to record opacity. The company provided ADEQ with a copy of the updated Weekly Opacity Survey report which demonstrated that those two sources had now been included.

The CAO provides that AI neither admits nor denies the factual and legal allegations.

A $3,600 penalty is assessed.
