Air Enforcement: Mississippi Commission on Environmental Quality and Smith County Sawmill Enter into Agreed Order

The Mississippi Commission on Environmental Quality (“MCEQ”) and Jack Batte and Sons Inc. (“JBS”) entered into a September 8th Agreed Order (“AO”) addressing an alleged violation of an Air Permit. See Order No. 7552 25.

JBS operates a sawmill in Smith County, Mississippi pursuant to the authority of a Clean Air Act Title V Operating Permit.

The facility is alleged to have failed to submit a timely renewal application to MCEQ Permit Board in violation of Condition 1.17 of the Title V Operating Permit. The renewal application is stated to have been due on February 28th.

JBS submitted a renewal application to the Permit Board on May 20th.

The AO requires that JBS comply with all terms and conditions of the Title V Operating Permit until the Permit Board acts on the renewal application received May 20th.
