Air Enforcement: Mississippi Commission on Environmental Quality and Jackson Coil Coating Facility Enter into Agreed Order

The Mississippi Commission on Environmental Quality (“MCEQ”) and Sequa Corporation, d/b/a Precoat Metals (“Sequa”) entered into a May 16th Agreed Order (“AO”) addressing an alleged violation of a Synthetic Minor Operating Permit (“Permit”). See Order No. 7191 22.

The AO indicates that Sequa operates a facility in Jackson, Mississippi.

Sequa holds Permit No. 1080-00080.

MCEQ is stated to have identified the following alleged violations of the Permit:

  • Condition No. 3-4: Emission of 18.80 tons of isophorone during the 12-month period ending June 30, 2021, which exceeds the permit limit of 9.0 tons per year for any individual hazardous air pollutant by 109%
  • Condition No. 3-4: Emission of 27 .11 tons of total hazardous air pollutants during the 12-month period ending September 30, 2021, which exceeds the permit limit of 22.5 tons per year by 20%

Sequa is stated to have submitted a Title V Operating Permit Application through an April 16, 2021, letter to the Mississippi Department of Environmental Quality’s Environmental Permits Division. A Title V Permit was issued to Sequa on October 7, 2021.

A civil penalty of $48,375 is assessed.
