The Tennessee Air Pollution Control Board (“Board”) issued on August 20th a proposed Technical Secretary’s Order and Assessment of Civil Penalty (“Order”) to Dynasty Spas, Inc. (“DSI”) addressing alleged violations of an Air Permit. See Case No. APC25-0096.
DSI is stated to operate a facility in Athens, Tennessee.
The facility is stated to have been issued a Major Source Operating Permit (“Title V Permit”) on March 29, 2021. The Title V Permit addressed a reinforced plastic composite parts manufacturing operation.
The Tennessee Division of Air Pollution Control is stated to have received on February 15th the facility’s semi-annual report ("Report") for the reporting period of July 1 through December 31, 2024. The Report indicated that during each month in this reporting period, the actual organic HAP emissions factor exceeded the corresponding weighted average emission limit (organic HAP emissions limit) as shown in the table in the Order.
On April 11th, a Notice of Violation was issued to DSI addressing the alleged violations.
The Order proposed a civil penalty of $26,000.00. Further, the facility is required to submit Proposed Schedule of Corrective Action within 30 days of receipt of the Order.
The Order provides certain appeal rights.
