Air Enforcement: Tennessee Air Pollution Control Board Proposed Order/Penalty for Camden, Tennessee Magnesium Smelting Operation

The Tennessee Air Pollution Control Board (“Board”) issued a January 8th proposed Technical Secretary’s Order and Assessment of Civil Penalty (“Order”) to MagPro, LLC, (“MagPro”) for alleged violations of an air permit. See Case No. APC-19-0090, APC-19-0148, APC-19-0157.

MagPro is stated to have been issued an operating permit (“Permit”) for an emission source for a secondary magnesium smelter operation (“Facility”) in Camden, Tennessee.

The Division of Air Pollution Control (“Division”) conducted an inspection on May 13, 2019 at the Facility.

Division personnel are stated to have conducted a Method 9 Visible Emission Evaluation (“VEE”) on a wet scrubber stack. The VEE is stated to have indicated the second-highest six-minute average was 35%. This is stated to have violated Condition 11 of the Facility’s operating Permit.

The Division is stated to have conducted a subsequent investigation at the Facility and performed a Method 9 VEE on the wet scrubber stack. The second-highest six-minute average was stated to be 38.13%, which is alleged to be an exceedance of the 10% opacity limitation as required by Condition 11 of the Permit.

An additional Method 9 VEE on the wet scrubber stack is stated to have indicated an exceedance of the 10% opacity limitation in Condition 11 of the Permit.

The Order assesses a civil penalty of $8,000.
