ALJ Pender Returns to ITC

A few weeks ago we reported that Administrative Law Judge (“ALJ”) Thomas B. Pender had retired from the ITC (here). In recent notices issued by Chief ALJ Bullock, some of the investigations that were previously assigned to ALJ Pender were reassigned to him.

The Notices specifically indicated that ALJ Pender “has returned to the Commission” to complete the particular investigation and that the investigation was therefore reassigned to him.

Notably, it did not appear that all of investigations previously assigned to ALJ Pender at the time of his retirement were reassigned to him. Accordingly, it seems possible that ALJ Pender was asked to return to the ITC for the limited purpose of completing the few cases that were reassigned to him.
