The Arkansas Department of Environmental Quality (“ADEQ”) and Shelby County Health Department-Air Pollution Control Program (“SCHD”) entered into a Memorandum of Agreement (“MOA”) titled:
AIR QUALITY MONITORING FOR PARTICULATE MATTER IN CRITTENDEN COUNTY FOR RESEARCH PURPOSES
The “Purpose, Objectives and Goals” are described as allowing:
. . . SCHD to locate a monitor intended to measure particles of an aerodynamic diameter of 10 micrometers and less (PM10) at a site where ADEQ currently operates monitors for particles of an aerodynamic diameter of 2.5 micrometers and less (PM2.5), ozone, and oxides of nitrogen (NOx) at the corner of Polk and Colonial Dr. in Marion, Arkansas (“the Site”). This MOA is intended to allow SCHD to install and operate the PM10 monitor for the purpose of performing a study in partnership with the University of Memphis intended to characterize community exposure to polycyclic aromatic hydrocarbons in the metropolitan area of Memphis, TN. This MOA is entered into with the understanding that the data produced by the PM10 monitor to be located at the Site will be used for research purposes.
The agreement also allocated responsibility between ADEQ and SCHD regarding the operation of the monitors and responsibility for damage. Further, SCHD is required to make all data collected from the monitor available to ADEQ upon request.
