BAG: Kein Sonderkündigungsschutz für Bewerber für den Wahlvorstand

Ein Arbeitnehmer, der für das Amt des Wahlvorstandes für eine geplante Betriebsratswahl kandidiert, ist kein “Wahlbewerber” i.S.d. § 15 Abs. 3, S. 1 KSchG. Mangels Sonderkündigungsschutzes bedarf eine Kündigung des jeweiligen Arbeitnehmers daher nicht der Zustimmung des Betriebsrats nach § 103 BetrVG, bzw. einer entsprechenden gerichtlichen Entscheidung.

Das BAG hatte folgenden Fall zu entscheiden: Der Kläger kandidierte für den Vorstand für eine Betriebsratswahl bei der Beklagten, einem Unternehmen welches Verpackungen produziert. Die Wahl des Wahlvorstandes sollte auf einer Betriebsversammlung am 10. Februar 2012 erfolgen, zu der ver.di eingeladen hatte. Die Betriebsversammlung nahm jedoch einen “unübersichtlichen Verlauf” und die Parteien waren sich einig, dass der Kläger dort jedenfalls nicht wirksam zum Wahlvorstand gewählt worden war.
Kurz nach der Betriebsversammlung stellte ver.di beim Arbeitsgericht den Antrag, einen Wahlvorstand zu bestellen, wobei sie den Kläger erneut als ein Mitglied des Wahlvorstandes vorschlug.

An einem der folgenden Tage äußerte sich der Kläger in einem von ver.di produzierten Video indem er erklärte, im Betrieb gebe es “Probleme”. An einzelnen Maschinen fehlten Sicherheitsvorkehrungen. Man könne “fast behaupten”, dass keine Maschine “zu 100 % ausgerüstet” sei. Das Problem sei, dass “keine Fachkräfte vorhanden” seien und das “Beherrschen der Maschinen nicht zu 100 % erfüllt” werde, sagte der Kläger in dem Video, das ab dem 22. Februar 2012 im Internet, u.a. bei YouTube, zu sehen war und das der Kläger auch über Facebook verbreitete. Daraufhin kündigte die Beklagte das Arbeitsverhältnis mit Schreiben vom 15.3.2012 fristlos.

Während Arbeitsgericht und Landesarbeitsgericht die Klage abgewiesen hatten, befand das BAG die außerordentliche Kündigung für unwirksam, gab der Revision statt und verwies den Rechtsstreit zur Prüfung einer bereits am 17.2.2012 erfolgten ordentlichen Kündigung aus einem anderem Grund an das LAG zurück.

Das BAG hielt die Kündigung nicht wegen eines Verstoßes gegen sonderkündigungsschutzrechtliche Vorschriften für unwirksam, weil eine Auslegung der einschlägigen Vorschriften eben ergebe, dass ein Kandidat kein Wahlbewerber i.S.v. § 15 Abs. 1, S. 1 KSchG ist. Die Kündigung sei aber mangels wichtigen Grundes unwirksam. Die Erklärungen in dem Video seien erkennbar darauf gerichtet gewesen zu verdeutlichen, weshalb der Kläger die Bildung eines Betriebsrates als sinnvoll ansah. Der Kläger habe dagegen nicht behaupten wollen, die Beklagte beschäftige überwiegend ungelernte Kräfte.
