As already stated in a previous blog post, on May 13, 2015, the Belgian Data Protection Authority issued a recommendation in which it expressed its concern about Facebook tracking users, non-users and logged-out users without their consent. It added that a failure to address such a situation would be seen as a breach of EU data protection laws.

In order to pressure Facebook to comply with the recommendation, the Belgian Data Protection Authority filed a lawsuit that was heard in a Brussels court on June 18. With Facebook claiming that only the Irish Data Protection Authority is qualified to regulate such situations, this lawsuit will again raise the question of whether the Brussels court has jurisdiction.
