This week’s news flash – a quick overview of timely background screening and immigration-related news that is important to your organization.

  1. President Trump signed a revised executive order restricting travel—known as the travel ban—to the United States by individuals from certain countries, suspending refugee admissions, and limiting the number of refugees admitted in fiscal year 2017 to 50,000 among other things. For employers this means that employees who are nationals of the affected countries (Iran, Libya, Somalia, Sudan, Syria and Yemen) are potentially restricted from travel to the United States as of March 16, 2017 unless they have a valid visa. This could also affect employees from the six countries currently in the United States who may be thinking of traveling outside the United States but their visa has expired. The travel ban does not affect lawful permanent residents. To learn more click here and here. The Attorneys General of Hawaii, Washington, Oregon, New York and Massachusetts are considering legal action against the executive order.

  3. Are you an employer that sponsors employees in H-1B status? Starting April 3, 2017, U.S. Citizenship and Immigration Services (USCIS) will temporarily suspend premium processing for all H-1B petitions. This suspension may last up to 6 months. 
  4. Are you an E-Verify Employer or E-Verify Employer Agent? March is the last month to download a Historic Records Report for cases over 10 years old. In April 2017 USCIS must dispose of E-Verify transaction records over 10 years old, which means transaction records created on or before December 31, 2006.   5. The Department of Homeland Security (DHS) has extended the validity period for holders of employment authorization documents (aka “work permits”) issued under the Temporary Protected Status (TPS) program for El Salvador. The extension runs through September 9, 2017. This is relevant for purposes of the Form I-9 and reverification of affected employees work authorization since the prior 6-month period ended March 9, 2017.
