Yesterday President Trump signed into law a resolution that officially kills the Obama-era “Blacklisting Rule.” The Rule promised to wreak havoc among federal contractors by requiring certain government contractors and subcontractors to report to the government mere alleged violations of a multitude of federal labor and employment laws and NLRB complaints when seeking awards of government contracts. The purpose of the Rule was ostensibly to allow the government to disqualify from federal contract awards those contactors who flaunt federal labor and employment laws. But the rule went much, much further by allowing the government to consider even unproven allegations of law violations. This is a major victory for government contractors, and it is a reminder that, whatever might have happened last week during the Obamacare Repeal/Replace debacle, the Trump administration is still working to reverse Obama-era executive orders on a variety of fronts.
