Dismissal for Flushing Bank in Patent Litigation

Hughes Hubbard successfully achieved dismissal with prejudice for Flushing Bank in a patent infringement lawsuit brought by DigitalDoors concerning methods for data processing, storage, and security.

DigitalDoors alleged that Flushing Bank infringed four of its patents in the bank’s use of its cyber security software.

On behalf of Flushing Bank, the firm argued that DigitalDoors never identified any specific product the bank used that infringed the claims of the patents, and that the remaining allegations were too vague and speculative to meet federal pleading standards. Additionally, the firm argued that DigitalDoors offered no factual basis showing that complying with cybersecurity regulations or using Sheltered Harbor systems necessarily violated the patents at issue in the dispute.

On Jan. 16, the Honorable Sanket J. Bulsara, U.S. District Judge for the Eastern District of New York, granted Flushing Bank’s motion to dismiss the DigitalDoors litigation with prejudice.

Since December 2023, DigitalDoors has filed more than 50 similar suits against financial institutions, with some being consolidated, some settled and others remaining in litigation.
