An interesting study was recently published discussing the potential advantages of adopting a system whereby liability insurance carriers are afforded the opportunity to make “early offers” in personal injury cases. This early offer system encourages liability insurers to issue prompt payment of medical expenses and wage loss to parties injured on a no-fault basis, with the injured party having to give up recovery of non-economic damages in exchange.
