EEOC Issues Pay Data Filing Instructions

Parker Poe Adams & Bernstein LLPLast week, the Equal Employment Opportunity Commission released instructions for employers required to file 2017 and 2018 pay information that includes a breakdown by demographics, referred to as Component 2 data. The instructions and support resources can be found here. The materials include a sample form, instruction book and user’s guide, and upload file specifications for electronic filing.

The data portal is now open, and employers can complete the required filings through September 30. The requirement applies to employers with more than 100 employees during the relevant workforce snapshot period in 2017 or 2018, the same requirement for filing traditional Component 1 EEO-1 information. These employers should have received letters notifying them of these requirements and containing instructions for obtaining passwords from the portal. Employers should maintain copies of all data submitted through the portal.
