EEOC Restores Voting Quorum as Trump Nomination Brittany Panuccio Sworn in as Third EEOC Commissioner

On October 3, 2025, the U.S. Senate confirmed President Trump’s nominee, Brittany Panuccio to serve as a commissioner at the Equal Employment Opportunity Commission (“EEOC”). Panuccio’s term expires in 2029. With Panuccio’s confirmation, the EEOC once again has a quorum of 3 members, meaning the agency will again be able to institute changes to its pre-existing regulations.

The Commission is currently composed of President Trump’s appointed Acting Chair Andrea Lucas, whose current term expires in July 2030, and President Biden’s appointed Commissioner Kalpana Kotagal, whose current term expires in July 2027.

Now that a quorum is in effect, the EEOC is expected to move forward with initiatives outlined in several public documents, including:

  • statement highlighting the EEOC’s mission to “protect[] women from sexual harassment and sex-based discrimination in the workplace by rolling back the Biden administration’s gender identity agenda”;
  • position statement stating that the EEOC will re-evaluate its final rules implementing the Pregnant Workers Fairness Act;
  • two guidance documents “focused on educating the public about unlawful discrimination” in the workplace related to Diversity, Equity, and Inclusion efforts;
  • an announcement of the EEOC’s intention to hold universities and colleges accountable for antisemitism on “campus workplaces” under Title VII; and
  • a statement asserting the EEOC’s intention to “rigorously enforce” antidiscrimination laws to ensure all workers are protected from national origin discrimination, including American workers.

Together, these pronouncements signal a significant and unprecedented shift in EEOC investigation and enforcement priorities.
