Red faces – no gross misconduct when employee revealed executive's pay

The EAT had to consider whether an employee had acted in breach of contract or committed gross misconduct when he revealed details of an executive's pay to colleagues. Jagex Ltd v McCambridge found that he had not.

Take your time – material factor defence operative until subsequent decision

In Co-operative Group Ltd v Walker the EAT decided that an employer's material factor defence to an equal pay claim continued to operate until it was superseded by a further pay-related decision or omission.

Who will guide my sleigh tonight? Courier a worker because no right of substitution

In another worker status case, Stuart Delivery Ltd v Augustine, the EAT found that a courier was a worker. Even though he could ask to release a shift he had agreed to work, this did not amount to a genuine right of substitution.
