The Governor of Florida just issued Executive Order Number 20-94 regarding mortgage foreclosure and eviction relief due to the effect COVID-19 is having on the ability of many Floridians to pay the mortgage on their single family homes and the ability of many tenants to make their rent payments.

The Governor suspended mortgage foreclosure actions for 45 days, and suspended evictions for non-payment of rent for the same length of time. This does not appear to effect the lien foreclosure causes of action under Florida Statutes 718 and 720 for condominium and homeowners’ associations. Nor does it prevent an association from proceeding with the processing of a pre-lien notice or a lien for the non-payment of assessments, should it choose to do so.
