The Alabama Department of Environmental Management (“ADEM”) and Mueller Company (“MC”) entered into a December 4th Consent Order (“CO”) addressing alleged violations of the Alabama hazardous waste regulations. See Consent Order No. 22-XXX-CHW/CSW.
The CO provides that MC operates a portable water flow control manufacturing and packaging facility (“Facility”) in Albertville, Alabama.
The Facility is stated to hold an EPA hazardous waste identification number. Further, MC is stated to be a large quantity generator as that term is defined in ADEM Admin. Code Div. 14.
MC is also stated to be a permitted landfill operator under a Solid Waste Disposal Permit.
A representative of ADEM’s Industrial Hazardous Waste Branch is stated to have conducted a compliance evaluation inspection (“CEI”) of the Facility on May 4th. The CEI and a review of MC’s compliance allegedly showed the following:
- Disposal of spent solvent contaminated filters in the Facility’s onsite solid waste landfill without an Alabama Hazardous Waste Management Minimization Act Permit.
- Storage of hazardous waste in the secondary containment system for the Forge Paint Area for more than 90 days without a permit or an extension.
- Disposal of a F005 hazardous waste into the onsite industrial landfill without the appropriate permit.
MC is stated to have responded to a previously issued Notice of Violation on August 16th.
MC is stated to neither admit nor deny ADEM’s contentions.
A civil penalty of $22,400 is assessed.
