Q: One of my employees is getting divorced and his spouse called asking for payroll and work schedule information.  How do I respond?

A: Being married does not give you a right to access the other person’s medical or work records. You should decline to provide information unless requested by the employee himself/herself or if you receive a valid subpoena for the information.  You should also think about which employees might be “back doored” - the spouse asking other employees directly - to access data and remind them (politely) of the requirements of confidentiality.
