Inclusionary Zoning: Ontario Government Extends Grandfathering for Toronto, Mississauga, and Kitchener

The Ontario Government has extended the grandfathering window for inclusionary zoning in Toronto, Mississauga, and Kitchener. Certain development applications submitted before July 1, 2027 will be exempt from inclusionary zoning.

On January 29, 2026, the Ontario Government filed O. Reg. 15/26, which amends O. Reg. 232/18, being the regulation for Inclusionary Zoning.

In Toronto, Mississauga, and Kitchener, developments will be exempt from inclusionary zoning if the following applications are filed before July 1, 2027:

  1. applications for Official Plan Amendment (if needed) and Zoning By-law Amendment; or
  2. applications for Site Plan Control Approval or Building Permit.

This grandfathering provision does not apply if a building permit was issued for the development before January 29, 2026.
