The Florida Office of Insurance Regulation has issued an Emergency Order related to Hurricane Irma.

Some of the more notable provisions of this emergency order are:
  • Limits insurers’ ability to cancel or non-renew personal residential or commercial residential policies covering a property that was damaged as a result of the hurricane or a wind loss for a period of 90 days after that property has been repaired.
  • Extends deadline related to any policy provision, notice, correspondence or law which would impose a time limit on an insured that was to have been performed on or after September 4, 2017 to December 3, 2017. This does not relieve policyholders with a Hurricane Irma claim from compliance with obligations to provide information and cooperate in those claims. It also does not apply to policies issued after September 10, 2017, and does not apply to premium due in the normal course of business.
  • Restricts an insurer or other entity that is regulated under the insurance code from canceling or non-renewing a policy or contract of insurance between September 4 and October 15 without written concurrence of the policyholder.
  • All notices of cancellation issued or mailed on or after August 25, 2017, through and including September 3, 2017, covering a person, property or risk in Florida shall be withdrawn and re-issued after October 15, 2017.
  • Instructs Insurers to streamline their claim payment processes to advance prompt and efficient claim services.
