Novità Normative e Giurisprudenziali - in vigore

1. Regione Basilicata - Recepimento dei criteri per il corretto inserimento nel paesaggio e sul territorio degli impianti da fonti di energia rinnovabili ai sensi del D.M. 10 settembre 2010

Con legge regionale n. 21 del 11 settembre 2017, la Regione Basilicata ha modificato ed integrato la legislazione regionale vigente in materia di autorizzazione di impianti alimentati da fonti di energia rinnovabili ai sensi del D.M. 10 settembre 2010.

In particolare, ai sensi dell’art. 6 del D.lgs. 28/2011, la Regione ha esteso l’utilizzo della PAS agli impianti fotovoltaici, idroelettrici, a biomassa ed eolici fino alla potenza di 200 kW prevedendo il rispetto di requisiti tecnici rigorosi per l’utilizzo di tale procedura per gli impianti eolici e fotovoltaici con moduli collocati a terra.

Le disposizioni esaminate si applicano anche a tutti i procedimenti in corso alla data di entrata in vigore della legge regionale.

Basilicata Region – Adoption of the criteria for the correct localization of renewable plants pursuant to Ministerial Decree 10 September 2010. With Region Law No. 21 of 11 September 2017, Basilicata Region modified and completed the provisions of law concerning the correct localization of renewable plants in the territory of the Region.

In particular, by implementing Article 6 of the Legislative Decree No. 28/2011, Basilicata Region has established the possibility to make use of the PAS authorization procedure for the construction and operation of photovoltaic, hydroelectric, wind, and biomass plants of a power up to 200 kW under strict technical criteria to be complied with for wind and ground-mounted photovoltaic plants.

Such law applies to the authorization procedures already started at the time of its entry in force.

2. Efficienza energetica, incontro GSE - ANIGAS

Nei giorni scorsi il GSE ha incontrato una delegazione di ANIGAS. Nel corso dell’incontro, l’Associazione ha svolto una presentazione, reperibile sul sito del GSE, sugli obiettivi di efficienza energetica dei soggetti obbligati del settore gas, evidenziato alcune criticità poste dalla nuova normativa contenuta nel DM 11 gennaio 2017.

Infine, l’Associazione ha presentato sommariamente lo stato dell’arte delle richieste di connessione di impianti di produzione di biometano.

Energy efficiency, meeting GSE – ANIGAS. In the recent days, the GSE had a meeting with a representation of ANIGAS which presented the energy efficiency obligations of the operators of the gas sector, highlighting some issues arising from the application of the Ministerial Decree 11 January 2017. During the same meeting, ANIGAS briefly reported about the current situation of the applications for the connection of biomethane plants.

3. Burden Sharing, on-line i dati statistici sui consumi di energia da fonti rinnovabili nelle regioni italiane

In data 29 settembre 2017, il GSE ha pubblicato sul proprio sito web il rapporto di monitoraggio statistico degli obiettivi nazionali e regionali sulle fonti rinnovabili di energia per gli anni 2012-2015 previsto dal DM 11 maggio 2015. 

Dal documento, reperibile sul sito del GSE, risulta che quasi tutte le regioni italiane hanno superato le previsioni di consumo di energia da fonti rinnovabili stabilite dal DM sopra citato per il periodo monitorato. Molte fra queste risultano aver superato anche gli obiettivi assegnati per il 2020.

Burden Sharing – the GSE publishes the data of renewable energy consumption concerning the Italian Regions. On 29 September 2017, the GSE published on its website the statistic report of the national and regional targets of renewable energy consumption for the period 2012-2015. The report shows that almost all the Regions have reached the targets established by the Ministerial Decree 11 May 2015 and some of them have already exceeded the 2020 targets.

4. Strategia Energetica Nazionale 2017(SEN 2017) – la memoria dell’Autorità

Con la memoria resa in data 28 settembre 2017, l’Autorità per l’energia elettrica, il gas e il sistema idrico (AEEGSI), con riferimento agli ambiti di sua competenza, ha formulato alcune specifiche considerazioni in merito alle proposte e alle misure di intervento individuate dalla SEN 2017, che presentano profili di particolare rilevanza o criticità.

L’AEEGSI ha posto l’attenzione, in particolare, sui temi dello “Sviluppo delle fonti rinnovabili ed efficienza energetica”, della “Sicurezza energetica” e della “Competitività nei mercati energetici”. Italy’s National Energy Strategy 2017 (NES 2017) - the Authority's guidelines. On 28 September 2017, the Authority for Electricity, Gas and Water, with reference to its areas of responsibility, made some specific considerations on the proposals and measures of the intervention identified by the NES 2017, developing appropriate tools to facilitate the proper implementation of the development goals of the network, avoiding the possible distortive effect on efficiency and market competitiveness. 5. L’energia in Parlamento questa settimana (9-13 ottobre 2017)

Tra i lavori parlamentari della settimana da lunedì 9 a venerdì 13 ottobre 2017, che riguardano energia, rinnovabili, efficienza energetica, edilizia, mobilità sostenibile e tutte le tematiche a esse connesse, si segnalano, in particolare, gli impegni :

i. delle Commissioni riunite II e X della Camera, circa la Proposta di direttiva del Parlamento europeo e del Consiglio che conferisce alle autorità garanti della concorrenza degli Stati membri poteri di applicazione più efficace e assicura il corretto funzionamento del mercato interno;

ii. delle Commissioni riunite VIII e X della Camera, in merito alla Comunicazione della Commissione al Parlamento europeo, al Consiglio, al Comitato economico e sociale europeo e al Comitato delle regioni, con riferimento all’Iniziativa per lo sviluppo sostenibile dell’economia blu nel Mediterraneo occidentale, nonché relativamente all’audizione del Ministro dello sviluppo economico, Carlo Calenda, e del Ministro dell’ambiente e della tutela del territorio e del mare, Gian Luca Galletti, sugli esiti della consultazione pubblica sulla nuova Strategia Energetica Nazionale; e

iii. della VI Commissione Finanze della Camera, con l’audizione informale dei rappresentanti dell’Unione petrolifera, nell’ambito della discussione della risoluzione 701191 Fregolent, relativa a interventi in materia fiscale, assicurativa e finanziaria sulle tematiche ambientali.

Energy in Parliament this week (9-13 October 2017). This week the Parliament will discuss, in particular way, about: (i) the Proposal for a Directive of the European Parliament and of the Council conferring more effective enforcement powers on the competition authorities of the Member States and ensuring the proper functioning of the internal market; (ii) the Communication from the Commission to the European Parliament, the Council, the European Economic and Social Committee and the Committee of the Regions on the Green Development Initiative for the Sustainable Development of the Western Mediterranean. Then, there will be the hearings of the Minister of Economic Development, Carlo Calenda, and of the Minister of the Environment and of the protection of the land and sea, Gian Luca Galletti, on the results of the public consultation on the new National Energy Strategy; and the informal hearing of representatives of the oil union, as part of the discussion of Resolution 701191 Fregolent, on tax, insurance and financial matters relating to environmental issues.

6. Eolico – Utile collocamento nella graduatoria della procedura d’asta – Mancato rilascio della cauzione definitiva – Decadenza dalla graduatoria ed escussione della cauzione provvisoria

Con la sentenza 3 ottobre 2017, n. 10022, il TAR Lazio, sede di Roma, ha ritenuto legittima la decisione del GSE di disporre la decadenza di un realizzando impianto eolico dalla graduatoria relativa alla procedura d’asta indetta ai sensi dell’art. 12 D.M. 6.7.2012 nonché l’escussione della cauzione provvisoria rilasciata dal soggetto responsabile dell’impianto stesso, utilmente collocato nella graduatoria stessa, che non ha costituito la cauzione definitiva nel termine stabilito dall’art. 16 del citato D.M. in ragione del mancato rilascio dell’autorizzazione unica.

Le ragioni di tale pronuncia discendono dal fatto che, la scelta di anticipare l’iscrizione alla procedura d’asta rispetto all’effettivo conseguimento del titolo, pur se ammessa dal citato Decreto, rientra nella discrezionalità della Società che assume pertanto il rischio sia del mancato rilascio dell’autorizzazione, sia del suo rilascio in tempi diversi da quelli auspicati.

Wind farm - Profitable placement in the auction procedure list - Missed release of the final security - Decline from the ranking and execution of the provisional security. With the decision No. 10022 of 3 October 2017, the Regional Administrative Court of Lazio, Rome, considered legitimate the GSE's decision to order the annulment of a wind farm installation from the ranking relating to the auction procedure referred to in Art. 12 D.M. 6.7.2012 as well as the enforcement of the provisional security issued by the responsible for the installation, which is well placed on the list itself, which did not constitute the final security within the time limit set by art. 16 of the quoted D.M, due to the failure to issue a single authorization. The reasons for that decision arise from the fact that the choice to advance the auction procedure with respect to the effective acquisition of the title, although permitted by the aforementioned Decree, falls within the discretion of the Company, which therefore assumes the risk of failure to the release of the authorization, and of its release at different times than the desired ones.

7. Riempimento cava con rifiuti diversi dai rifiuti di estrazione

Con la sentenza 10 ottobre 2017, n. 4690, la Quinta Sezione del Consiglio di Stato, nel richiamare i principi principi espressi dalla IV Sezione della Corte di Giustizia nella pronuncia del 28 luglio 2016, ha stabilito che, nell’ipotesi di riempimento dei vuoti di cava con rifiuti diversi dai rifiuti di estrazione, si verifica una vera e propria ipotesi di "operazione di recupero ambientale", sottoposta dal d.lgs. n. 152 del 3 aprile 2006 al regime autorizzatorio della procedura semplificata ex art. 214 e 216. Laddove, invece, i rifiuti da utilizzare nel riempimento dei vuoti di cava non siano riconducibili alla tipologia dei rifiuti che il D.M. 5 febbraio 1998 espressamente destina alla citata attività di recupero, si configura una vera e propria "attività di smaltimento rifiuti", assoggettata al più rigido regime autorizzatorio di cui all’art. 208. Del d.lgs. n. 152/2006.

The filling up of a quarry with waste other than extraction waste is not classified as disposal if it is the object of recovery: the Council of State refers to the principles expressed by the Court of Justice with the pronouncement of Section IV on July 28, 2016. With decision No. 4690 of 10 October 2017, the Council of State established that the filling up of a quarry with waste other than extraction waste is not classified as disposal if it is the object of recovery, so that is surely applicable the authorization system referred to in article No. 214 and No. 216 of the Legislative Decree No. 152 of 3 April 2006.

8. Permesso di costruire: decorrenza e richiesta di proroga del termine per l’avvio dei lavori: interviene il Consiglio di Stato

Con sentenza n. 4704 dell’11 ottobre 2017, la Quarta Sezione del Consiglio di Stato, riformando quanto sostenuto dal giudice di prime cure, ha stabilito che "il mero rilascio di un permesso in variante all’originario permesso per costruire non fa decorrere … un nuovo termine di avvio e di conclusione dei lavori, il quale va sempre determinato con riferimento al titolo edilizio originario, con ogni conseguenza in ordine alla sua decadenza". Allo stesso tempo, la citata Sezione ha rilevato la legittimità della richiesta di proroga del termine di inizio lavori richiesta prima che sia maturato il termine di scadenza per l’inizio dei lavori stesso e, sul piano contenutistico, si è verificata una delle ipotesi tipicamente previste dal legislatore (cfr. l’art. 15 del d.P.R. 6 giugno 2001, n. 380), in punto di meritevolezza dell’interesse del privato istante ad ottenere lo spostamento del citato termine.

Permission to build: start and request to extend the deadline for the start of the works. With the decision No. 4704 of 11 October 2017, the Council of State stated that the mere issuance of a permit as a variant of the original permission to build does not start a new term of starting and ending of the work, which must always be determined with reference to the original building title. At the same time, the abovementioned Judge has found the legitimacy of the request for extension of the time-limit for commencement of the works, required before the expiry date for the start of the works, wheneverit is justified whenever it is justified by an interest of the private which deserve protection.
