January Consumer Litigation Filings: 2026 Starts Out with a Bang

According to a recent report by WebRecon, court filings under the Fair Credit Reporting Act (FCRA), Fair Debt Collection Practices Act (FDCPA), and Telephone Consumer Protection Act (TCPA), as well as complaints filed with the Consumer Financial Protection Bureau (CFPB) were all up compared to January 2025. Compared to December 2025, however, the results are mixed.

WebRecon reports the overall statistics for consumer litigation in January as follows:

  • 832 FCRA cases were filed, representing an 11.1% increase from December;
  • 396 FDCPA cases were filed, representing a 13.5% decrease from December;
  • 219 TCPA cases were filed, representing a 1.4% decrease from December; and
  • 30,983 complaints were filed with the CFPB, representing a 2.1% increase from December.

Complaints and filings are all up compared to the same period in the prior year (January 1 to December 31, 2025): FCRA +47.5%, FDCPA +26.5%, TCPA +5.8%, CFPB +26.0%.
