USCIS released yesterday the latest Form I-9, Employment Eligibility Verification. Employers may continue using the old Form I-9 with a revision date of 11/14/16 N through Sept. 17 (the revision date is indicated in the bottom left corner of the form).

Beginning Sept. 18, employers must use only the revised form with a revision date of 07/17/17 N. The storage and retention rules for any previously completed Form I-9 remain unchanged.

The revised form includes under List C of acceptable documents Form FS-240, Consular Report of Birth Abroad.  In addition, the new form has slightly edited instructions to Section 1 to confirm that newly hired employees must complete and sign Section 1 no later than the first day of employment. The form also provides the new name of the Office of Special Counsel Immigrant and Employee Rights Section.
