House Bill 4524 has cleared both chambers of the Michigan Legislature and is now on its way to Governor Whitmer for signature. The measure was granted immediate effect, so its provisions will become effective if and when it is signed into law.
What HB 4524 Does
HB 4524 amends the Marketable Record Title Act (MCL 565.101 et seq.), which restricts the enforceability of certain claims or interests in real estate unless they are reaffirmed periodically. Under current law, holders of such interests must properly file a notice to preserve their claim within a 40-year period in order to maintain those rights. Failure to do so within the statutory timeframe can result in the interest being extinguished.
The bill makes a significant change by extending the current September. 29, 2025 deadline to file a notice of claim by an additional two years from the date the Act goes into effect. This provides property interest holders with a longer window to review their holdings and ensure interests are not inadvertently lost.
Why This Matters
By extending the filing period, HB 4524 reduces the risk that valuable interests held by owners, associations and others with record interests in real property — such as easements or restrictive covenants — will be extinguished due to a missed deadline. Because the bill was passed with immediate effect and is expected to be signed, the new two-year extension period will begin as soon as the governor signs the bill.
