New York City Issues New Construction Health And Safety Rules For Phase One Of Reopening

The New York City Department of Buildings (DOB) has announced that the city will enter Phase One of the State Reopening Plan on June 8. Work on all job sites will continue subject to permits issued by the DOB or otherwise regulated by the New York City Construction Codes and the New York City Electrical Code, as long as they comply with the Interim Guidance for Construction Activities During the COVID-19 Public Health Emergency published by New York State.

The new COVID-19 safety guidance rules that the DOB has issued include, but are not limited to the following:

  • Ensure 6 feet of distance between personnel unless safety or core functions of the work activity requires a shorter distance.
  • Anytime personnel are less than 6 feet apart from anyone, they must wear face coverings.
  • Tightly confined spaces (e.g. elevators, hoists) can be occupied by only one individual at a time OR under 50% maximum allowed number if all occupants wear face coverings. 50% capacity must be posted within the cab AND at each landing.
  • Hand hygiene stations must be available on site and readily accessible to workers.
  • A cleaning and disinfection log must be present at the site with, at minimum, daily entries.
  • A site safety monitor must be designated whose responsibilities include continuous compliance with all aspects of the site safety plan.

New York State Department of Health

The New York State Department of Health has issued guidance on construction activities. Employers are to develop a site-specific heath plan that is prominently displayed at work sites. The state has made available a business reopening safety plan template to guide business owners and operators in developing plans to protect against the spread of COVID-19.
