On January 15, 2022, the New York City Human Rights Law was amended, requiring New York City employers with more than four employees to include the salary range in job postings.

The amendment will take effect on or around May 15th. More guidance is expected to come to help answer some lingering questions, including the impact it will have on employers with remote workers.

Throughout the U.S., other cities and states have recently implemented similar requirements on employers, such as California, Colorado, Connecticut, Maryland, Nevada, parts of Ohio, Rhode Island, and Washington, with more states likely to follow. While the majority of these laws put the burden on the applicant to ask for the position’s salary range, the New York City law requires employers to disclose this information upfront.

This trend of increasing pay transparency has largely been driven by discussions of improving pay equality and ensuring fair pay across race, gender, and other demographics.
