  • Washington AG Nick Brown reached a settlement with O’Reilly Auto Enterprises, LLC for allegedly violating the Healthy Starts Act, the Washington Law Against Discrimination, and the Consumer Protection Act by systematically denying pregnancy-related accommodations.
  • In the previously reported complaint, the state alleged that O’Reilly denied requests for accommodations such as restroom breaks, work schedule changes, seating, and lifting restrictions, and retaliated against some pregnant workers through negative performance reviews, forced unpaid leave, threats of termination, and other adverse actions.
  • Under the terms of the consent decree, O’Reilly must pay $5.6 million into a settlement fund for compensatory damages, civil penalties, and future monitoring costs; the company is also permanently enjoined from denying statutorily mandated accommodations.
  • The agreement further requires O’Reilly to implement mandatory anti-discrimination training, modify its automated HR systems to include direct links to state-specific policies, and submit biannual compliance reports to the AG’s office for the next four years, among other obligations.
