On October 08, 2025, The Brazilian Government published new regulations around what activities can be performed in Brazil on a visitor visa.
Visitor visa activities now expressly include technical assistance and technology transfer activities.
This is a welcome change, simplifying the process for many short-term assignments to Brazil. Previously the above-mentioned activities required a foreign national to secure a work visa under the VITEM V category.
We are waiting on the government to provide detailed guidance on how this new regulation will be implemented, including more specifics on the scope and definition of the activities that will be encompassed under technical assistance and technology transfer.
During this initial phase and throughout the rollout of this new regulation, we expect confusion from immigration authorities at airports via the border inspection process. As a result, it is critical that individual case assessments are conducted to ensure that activities being performed in Brazil on a short-term assignment fall within this business visitor exemption and do not require a work visa.
