Stormwater Enforcement: Mississippi Commission on Environmental Quality and Solar Facility Construction Site Operator Enter into Agreed Order

The Mississippi Commission on Environmental Quality (“MCEQ”) and McCarthy Building Companies, Inc. (“MBCI”) entered into an Agreed Order (“AO”) addressing alleged violations of the Mississippi Large Stormwater Construction General Permit (“Permit”). See Order No. 7070 20.

The AO provides that MBCI was contacted by MCEQ and notified of alleged violations at its Meridian, Mississippi, construction site.

The alleged violations include:

  • ACT6 S-1 (1): Failure to implement the site-specific Storm Water Pollution Prevention Plan (“SWPPP”)
  • ACT6 S-3 (11): Failure to maintain erosion and sediment controls
  • ACT6 S-5 (1): Failure to meet inspection requirements

MBCI is stated to have indicated by letter dated August 21st that it had revised the site-specific SWPPP to enhance site erosion and sediment controls, asserted Best Management Practices are being maintained in accordance with the Permit, and retained PPM Consultants to conduct the required inspections.

The AO assesses a civil penalty of $55,000.

The AO provides that MBCI does not admit liability.
