Recently, NAM and the ABA collaborated in conducting a CLE webinar entitled, ADR in Divorce: Fast Tracking Resolutions. Three of NAM's well-regarded neutrals, Hon, Jeffrey S. Brown (Ret.), Elena Greenberg, Esq. and Hon. Jeffrey D. Lebowitz (Ret.) were joined by Samuel Ferrara, Esq. of Abrams, Fensterman in this well-received presentation.

The esteemed panel addressed vital points to be considered when mediating matrimonial matters and provided tips for maximizing the outcome when utilizing ADR for resolving issues that arise in divorce proceedings.

This engaging 60-minute presentation was followed by a lively Q&A session that served to reinforce the following key takeaways:

  • ADR is an efficient and economical means of resolution for matrimonial disputes and family law matters;
  • in private mediation, parties agree on who can mediate their case, whereas dissolving a marriage through the court is not only time consuming and emotionally draining, but also costly. It is better to leave the terms and conditions of the divorce in the hands of the parties rather than a judge. Due to the Covid pandemic – courts are interminably backed up and going to trial is not a viable alternative;
  • all communications during the mediation are confidential;
  • in mediation, matters can be arbitrated or mediated within a month of the attorney's request; and
  • many cases settle after the conference as a result of the mediator's post-hearing follow-up.
