Following the U.S. and China trade meetings last week, President Trump issued an Executive Order reducing the rate of fentanyl-related tariffs on China from 20% to 10%, effective November 10, 2025. These tariffs were originally imposed under the International Emergency Economic Powers Act (“IEEPA”) on February 1 and March 3, 2025 to address China’s failure to alleviate the influx of synthetic opioids into the U.S.

HTSUS heading 9903.01.24 is therefore amended to reflect an ad valorem duty rate of 10% with respect to goods entered for consumption, or withdrawn from warehouse for consumption, on or after 12:01 a.m. eastern standard time on November 10, 2025. The Executive Order has not yet been published in the Federal Register.

Additionally, in another Executive Order, President Trump suspended the heightened 34% reciprocal tariffs also imposed on China under IEEPA to November 10, 2026. Therefore, the current reciprocal tariff rate on China also remains at 10%.

Under this announcement, HTSUS heading 9903.01.63 and subdivision (v)(xvii)(10) of U.S. note 2 to subchapter III of chapter 99 of the Harmonized Tariff Schedule of the United States shall continue to be suspended until 12:01 a.m. eastern standard time on November 10, 2026

Neither Executive Order has been published in the Federal Register yet.
