UIC/Wastewater Enforcement - Bethel Heights, Arkansas Notice of Violation: Adjoining Property Owners' Petition to Intervene

As noted in a September 13th post (see previous post here), the Arkansas Department of Energy and Environment filed a Notice of Violation (“NOV”) against the City of Bethel Heights, Arkansas (“Bethel Heights”) alleging violations of a No-Discharge Permit.

Bethel Heights subsequently filed a response to the NOV (see previous post here).

A number of individuals who describe themselves as property owners adjoining the Bethel Heights wastewater facility (collectively “Intervenors”) filed a September 25th pleading titled:

The Adjoining Property Intervenors’ Petition to Intervene, Incorporated Brief, and Statement in Support (“Petition”)

The Intervenors request that they be permitted to intervene in the current proceeding. Referenced is LIS No. 19-07-NOV. They describe themselves as:

. . . independent owners of real property which adjoins to Bethel Heights wastewater disposal site located on Lincoln Street within the City . . .

The Petition references September 25th comments they filed on the NOV.

The Petition asserts that the Intervenors are entitled to intervene both by right and/or should be allowed to intervene by permission.
