Seyfarth Synopsis: The San Francisco Fair Chance Ordinance (the “FCO”), which was amended as of October 1, 2018, has long required that covered employers provide employees with the Office of Labor Standards Enforcement’s proscribed FCO notice and that they also post the notice in their workplaces in the city. The San Francisco Board of Supervisors recently updated the mandatory FCO Notice for employers with 5 or more employees and City contractors of any size. While the substance is consistent with the prior versions of the notice, the latest version has resulted in a much shorter “official” notice.

Employer Outlook

Covered employers (especially multi-state employers) located in San Francisco and consumer reporting agencies should ensure that they are using the most current version of the FCO notice.
