Virginia Legislature Passes High-Risk AI Developer and Deployer Act

On February 20, Virginia’s Democrat-controlled legislature passed the Virginia High-Risk Artificial Intelligence Developer and Deployer Act (HB 2094). The bill next moves to Virginia Republican Governor Youngkin for consideration. The Virginia Act is similar-in-kind to last year’s Colorado AI Act but contains several important differences that make its scope narrower than Colorado’s law.

In general, the Act does not seek to broadly regulate the use of AI but rather regulates machine-learning based AI systems used to make consequential decisions for certain covered activities such as education enrollment, financial or lending services, and access to health care services.
