Waste Tire Enforcement: Mississippi Commission on Environmental Quality and Jackson Waste Tire Stockpile Owner Enter into Agreed Consent Order

The Mississippi Commission on Environmental Quality (“MCEQ”) and Vemoci, LLC (“Vemoci”) entered into a January 8th Agreed Consent Order (“ACO”) addressing issues associated with a waste tire pile. See Order No. 7533 25.

The ACO provides that the Mississippi Department of Environmental Quality (“MDEQ”) confirmed through an ongoing investigation the abandonment of an estimated 50,000 waste tires at Vemoci property in Jackson, Mississippi.

Vemoci is stated to be aware that the waste tire stockpile may create a nuisance and a public health and safety problem. The company is stated to have requested MDEQ to assist with removal of the waste tires stockpiled on-site.

The ACO provides that in order to fully remediate the site and remove the waste tires, MCEQ and Vemoci have agreed to certain measures:

  • Allowing an MDEQ contractor to enter the premises and remove and transport the waste tires for proper disposal.
  • Agrees to have a selected waste tire abandonment contractor remove, transport, and properly dispose the waste tires in accordance with the terms of the contract between MDEQ and the contractor and the applicable laws/regulations of the State of Mississippi.
  • Provide that Vemoci is the lawful owner of the property and will provide access to MDEQ and its contractors.
  • Agrees to indemnify, save, and hold harmless the State of Mississippi, MCEQ, MDEQ, and all of their employees, officers, and contractors from and against any and all claim, demand, cause of action, liability, loss, damage, injury, suit, judgment, debt, and costs including attorney’s fees or expenses arising out of, or incident to the abatement of the waste tire stockpiles.
